Rulemaking Hearing Oct. 15, 2025
 

We will be conducting a rulemaking to update 5 CCR 1006-2, Medical Use of Marijuana to align with new statutory changes.  

Summary of the changes  

House Bill 25-1296 recently passed, and now pursuant to CRS 25-1.5-106 (16)(a), we can accept copies of federal tax returns received from the Internal Revenue Service (IRS) from applicants who are requesting a fee waiver. 

If you are requesting a fee waiver you can now submit: 

  • A copy of a certified Colorado tax return for the current tax year, or
  • A copy of a federal tax return received from the IRS.

The proposed changes align with these statutory updates, while also providing additional clarification about the information the documents need to include.

There are opportunities to provide testimony. The Board encourages written testimony, as the amount of time for oral testimony may be limited. This also gives the Board more time to study your feedback,

You may submit your testimony by email or physical mail. 

  • Due by Oct. 9 at 5 p.m.
  • Email testimony to: cdphe.bohrequests@state.co.us
